Terms and Conditions
Introduction
These Terms and Conditions govern your relationship with Collector Con Pty Ltd (“Collector Con”, “we”, “us”, “our”) and apply to all persons who:
(a) attend any Collector Con event, as a Visitor (as defined below) or otherwise;
(b) participate in any Collector Con event as a Stallholder;
(c) access or use the Collector Con website.
By attending our events or using our website, you agree:
(a) you are bound by; and
(b) to comply with;
these Terms and Conditions.
If you disagree with any part of these Terms and Conditions, do not use our website or attend our events.
Definitions
Application: refers to the online application form, that is located on the Website, being an application for the purpose of a person becoming a Stallholder.
Collector Con: means Collector Con Pty Ltd.
Event: means any event operated by Collector Con, in its ordinary course of business, including but not limited to the events known as “Collector Con”, “Dolltopia” and “TCXPO”.
Stallholder: refers to any person or entity who has applied for or is participating in a stall space as an exhibitor or vendor at the Event, and includes for the avoidance of doubt traders, hobbyists, collectors, businesses, special guests, artists, community groups or activation entities, and their employees, contractors or helpers.
Stall: means an area within the Event that is designated by Collector Con to a Stallholder for the sole purpose of trading.
Stall Fee: means the amount charged for a Stall, payable by the Stallholder to Collector Con.
Trading Hours: means the hours that an Event is open for trading, as determined by Collector Con in respect of any given Event.
Venue: means the location where any given Event is held.
Visitor: means any person who attends an Event, whether doing so as a paying ticket holder or otherwise.
Website: means the websites retrievable at the internet addresses: www.collectorcon.com.au; www.dolltopia.com.au; and www.tcxpo.com.au.
In these Terms, wherever appropriate, singular includes the plural and vice versa.
General Conduct Terms
You and Collector Con acknowledge and agree:
1. You attend any Event, and enter any Venue at which an Event is held, at your own risk.
2. You must follow all reasonable directions and requests given (prior to, during or after an Event) by:
1. the Venue owners, operators, tenants, and occupiers, and
2. Collector Con, including our staff, security, and volunteers.
3. Collector Con has the right to refuse admission or to eject any person for behaviour that Collector Con, or any of its staff, security, and volunteers suspects:
1. may cause damage, injury, nuisance, or annoyance to any other person;
2. amounts to a failure to comply with reasonable directions and requests contemplated by clause 2; or
3. that is anti-social to any degree, including high-risk behaviour to oneself and others.
- That:
- intoxication, aggressive or anti-social behaviour by you is unacceptable and will result in ejection from the Venue and Event at the discretion of Collector Con. Those ejected from the Venue and Event will not be entitled to be re-admitted to the Event or receive a refund;
- no persons in attendance at the Event may engage in any conduct, act towards, or speak to others in a manner that offends, insults, humiliates, intimidates, threatens, disparages, or vilifies that other person based on their race, religion, colour, gender, sexuality, disability, descent, or national or ethnic origin;
- any alleged behaviour at an Event that may amount to criminal conduct or unlawful conduct may be forwarded to the appropriate authorities (and where appropriate police and law enforcement authorities) along with any supporting details and/or documents presented to Collector Con from those reporting and/or those being reported. This includes behaviour before, during, and after Events;
- Collector Con has the right to eject persons, retain funds, and report conduct to authorities in the manner contemplated by the above sub-clauses.
- Collector Con has the right to inspect all bags upon entering and exiting the Venue and / or Event, and at any time during the Event, and for the avoidance of doubt you grant that right to Collector Con.
- No pets or animals are allowed other than designated guide or assistance animals.
- That:
- children must be accompanied by a parent or guardian at any Collector Con Event;
- parents and guardians are solely responsible for supervising children in their care and/or responsibility during any Event;
- Collector Con, its staff and its volunteers are not responsible for supervising or ensuring the safety of children, unattended or otherwise;
- children must remain under direct supervision of their parent or guardian throughout any Event;
- some audio and visual content displayed at Collector Con may be rated MA15+ and access restrictions may apply in some areas to those under the age of fifteen (15).
- Events are drug and alcohol-free events. No alcohol or illicit drugs can be brought into and/or consumed within the Venue or at the Event.
- Smoking and vaping is not permitted within the Event space. Refer to Venue specific restrictions as to whether and where smoking is permitted.
- Shoes must be worn at all times during any Events. The wearing of heels may not be permitted by the Venue to protect their flooring.
Prohibited Items
- Patrons will not be permitted to bring any glass items or weapons into the venue. This is inclusive of realistic imitation props, projectiles or items prohibited from by law, for example gel blasters. Prohibited items may be confiscated by Collector Con. Collector Con accepts no responsibility for confiscated items.
Health and Safety
- All persons at any Event must comply with any safety requirements or restrictions in force at the relevant time, including public health measures, and public health orders, and any rules for attendance imposed by the Venue owners, operators, tenants, and occupiers, as applicable.
- All persons at any Collector Con Event are responsible for their own personal property. Collector Con does not accept responsibility for any loss, theft, or damage to personal belongings.
- In the event of an emergency, all persons at any Collector Con Event must follow the instructions of staff, security, and volunteers, and proceed to designated assembly areas, if an evacuation is directed from either the Venue owners and operators, or Collector Con.
Emergency Procedure
- In the event of an emergency, you must:
- if safe to do so, immediately notify Collector Con staff or Venue personnel of any emergency matters or significant risks that arise during the Event;
- in case of evacuation, make your way to the designated emergency assembly area if safe to do so. Do not return to the evacuated area until instructed to do so;
- if someone is injured and the injury is life-threatening, call emergency services (000). Remain calm and send for help—this may include First Aid attendants, Collector Con event team members, and/or Venue staff;
- report all injuries, incidents, near misses, and hazards to Collector Con at the Collector Con information desk.
Tickets and Entry
- To the extent permitted by law, all entry tickets are non-refundable and non-exchangeable under any circumstances, including but not limited to change in personal circumstances, event changes, or inability to attend. This is a ‘no-refund’ policy that applies to all tickets purchased for any Collector Con Event.
- Collector Con has the right to:
- cancel, re-schedule, relocate any Event or anticipated Event,
- add, withdraw or substitute Stallholders, activities and other participants in the Events;
- vary advised programs, prices, venues, floorplans and audience capacity at the Event;
without notice to you.
- Unless otherwise provided by Collector Con in respect of a given Event, all tickets are general admission entry and seating in seminar areas is on a ‘first come, first served’ basis unless otherwise noted or signed.
- Venue or room capacity limits will be enforced and you may be refused entry to a space until such time as that space is available to enter.
- Entry to and attendance at any Event is monitored and controlled through the use of wristbands and re-entry stamps issued by Collector Con. Wristbands and re-entry stamps (as applicable):
- are non-transferrable;
- must be shown at the request of Collector Con;
- must be worn throughout the Event;
- are a means by which attendance at the Event is controlled and therefore any person found without a valid wristband or re-entry stamp may be removed from the Event at Collector Con’s discretion.
Photography and Recording
- No commercial photography, filming or recording including photo studio-type setups, such as tripods and flash instruments and backdrops on show floor, foyers or within Collector Con boundaries is permitted at any Event without prior permission from Collector Con.
- Handheld cameras, including phone cameras, for personal use are permitted to be used.
- Producers of photographic, video, or other media producing content at an Event (except Collector Con and its assigns) must obtain appropriate waivers and releases from Collector Con, the Venue owners, and participants captured, if content will be used for any purpose, including commercial media, broadcast or narrowcast, sale or reproduction.
- All persons, of any age:
- acknowledge that they, or their children, may be filmed or photographed whilst attending a Collector Con Event. Upon entry to a Collector Con Event, You agree and grant permission to Collector Con, its agents and others working under its authority, to take and to have full and free use of video/photographs containing their or their children’s image/likeness. These images may be used for promotional, news, and online/multimedia purposes, or any other purpose, by and for Collector Con, its agents, its nominees, and its assigns.
- agree that they, or their children, are not entitled to remuneration, residuals, royalties or any other payment from Collector Con in respect of their image/likeness or its use, nor any video, photographs or any other media.
- release, discharge, and hold harmless Collector Con and its agents from any and all claims, demands or causes of actions that they may hereafter have by reason of anything contained in the video, photographs or any other media.
Liability and Indemnity
- To the full extent permitted by law, Collector Con excludes all liability in respect of any claim, action, obligation, sum of money, suit, cause of action, proceeding, account, right of contribution, cost or expense whether at law or in equity in respect of any matter arising out of these Terms or related to arising out of any Event, including but not limited to: injury; loss of property; loss in opportunity; damage to goodwill, business or reputation; any other loss or damage of any sort.
- You agree to indemnify and hold harmless Collector Con, its officers, directors, employees, and agents, from and against any claims, actions, suits or proceedings, as well as any losses, liabilities, damages, costs and expenses (including reasonable legal fees) that arise from or relate to your attendance at our Events or use of our website.
- Collector Con is not a party to any transaction between Stallholders and/or Visitors. Any goods or services supplied by Stallholders or Visitors at the event are supplied by those directly between Stallholders and Visitors.
- Collector Con does not enter into any contract with Stallholders and Visitors for the supply of any goods or services between Stallholders and Visitors. Collector Con makes no representations or warranties about the quality, suitability, or legality of any goods or services supplied by Stallholders or Visitors.
- Any issues, disputes, or claims regarding goods or services purchased or traded between Stallholders and Visitors is a matter between the Stallholders and Visitors.
Website Use
- Collector Con is the operator and owner of the Websites.
- Users of the Websites, including for the avoidance of doubt, You, agree to be bound by these terms and conditions, which are subject to change at the sole discretion of Collector Con. Your use of the Websites confirms for the avoidance of doubt your acceptance of these terms and conditions.
- All intellectual property in material included on or available at the Websites belongs to Collector Con or its licensors or assigns, and users of the Websites obtain no interest or claim in that property.
- Users of the Websites may not do anything which interferes with or breaches any laws with respect to intellectual property rights in the material on display at the Websites.
- Users may download and view the material or print a copy of material on the Websites for personal, non-commercial use provided you do not modify the copy from how it appears on the Websites (including any copyright notice). All rights not expressly granted under these terms of use are reserved.
- The Websites may include content made or owned by third parties which is subject to those third parties’ terms and conditions of use.
- The Websites may include links to third party sites which are not related to Collector Con and in relation to which Collector Con has no control or interest. The appearance of those links on the Websites does not indicate any relationship between Collector Con and that third party or any endorsement by Collector Con of that third party, its site or the products or services which it is advertising on the Websites.
- Collector Con will have no responsibility or liability in relation to any loss or damage which you incur, including damage to your software or hardware, arising from your use of or access to the Websites.
- You will not use the Websites for any purpose or in any way which is unlawful.
Changes to Terms and Conditions
- Collector Con reserves the right to change these Terms and Conditions at any time. Changes will be posted on our website. Your continued use of the website or attendance at our Events after any changes indicates your acceptance of the revised Terms and Conditions.
Stallholder Specific Terms
- These below terms and conditions apply as between Collector Con and Stallholders.
- Persons interested in hosting a stall at Collector Con events must complete a Stallholder Application Form which is accessible on the Website.
- Stallholders agree to provide Collector Con with the following contact details and to always ensure that the information is current (including by updating those details with Collector Con from time to time): full name, address, email address, telephone number, trading name, selling categories and if applicable, Business/Company name, ABN/ACN, digital addresses (e.g., web site), and business address.
- Collector Con has the total discretion to accept or decline any Stallholder Application.
- Stallholders that are accepted to host a Stall will be:
- Emailed a confirmation of their Stall booking/s;
- Issued an invoice for payment of their Stall Fee or provided with a link to a payment portal to make payment of their Stall Fee by the due date; and
- Requested to provide a copy of their public liability Certificate of Currency to Collector Con by a due date.
If the Stall Fee or submission of Certificate of Currency is not provided by the due date, the booking will be cancelled and the Stall returned to the pool of available spaces to be allocated to another Stallholder.
- Stallholders are not permitted to transfer or sub-lease their Stall. If a Stallholder is found to transfer or sub-lease their Stall, their booking and all future bookings will be cancelled and returned to the pool of available spaces to be allocated to another Stallholder.
- Stallholders must hold valid and current public liability insurance of at least $20 million and provide Collector Con with a Certificate of Currency. Collector Con cannot recommend an insurance policy suitable for your Stall. Please contact your insurance broker to enquire about the most suitable coverage for your Stall at the Event.
- Stall Fees are published on the Website and are charged on a per table basis, unless otherwise stated on the Website.
- Stallholder entry wristbands are allocated per number of tables booked:
1. Two entry wristbands are allocated for 1-2 tables;
2. Three entry wristbands for 3 tables;
3. Four entry wristbands for 4 tables;
4. Five entry wristbands for 5 tables; and
5. Six entry wristbands for 6 tables.
If extra wristbands are required, up to two additional wristbands can be purchased per Stall. The cost of additional wristbands is equivalent to an Early Bird ticket for that event. Stallholder wristbands must be worn at all times during bump in, the Event and bump out.
- Stallholders bring items to the event at their own risk. Collector Con does not guarantee in any way the security of Stallholder items, chattels or personal possessions including risk from loss, theft, damage or otherwise.
- For the avoidance of doubt, Stallholders specifically agree and acknowledge that Collector Con does not make, and has not made, any representation as to likely or possible income or revenue that will or could be generated by Stallholders at any Event (nor any other benefit, financial or otherwise), and Collector Con does not guarantee that Stallholders will generate any income, or avoid suffering loss, by participating in any Event.
- Stallholders must comply with Australian Consumer Law and any other applicable statutes or laws in force from time to time.
- Stallholders must hold any necessary licenses or registrations to use or display the items or engage in the activities they offer and display at their Stall.
- Should a Stallholder cancel their paid booking, a minimum of 30 days notice is required. The cancellation must be received by Collector Con in writing to hello@collectorcon.com.au
- If cancellation by the Stallholder occurs 30 days or more from the Event, 85% of the Stall Fee will be credited to a future Event and the credit will be valid for 12 months.
- If cancellation by the Stallholder occurs within 30 days of the Event, the full Stall Fee will be retained by Collector Con (unless determined otherwise by Collector Con in our sole discretion).
- Should Collector Con cancel or postpone an Event:
- Stallholders will be notified via email at the address you have provided to Collector Con, or such other appropriate contact method at the discretion of Collector Con.
- If the cancellation by Collector Con occurs prior to the commencement of the Event, the Stall Fee will be credited to a future event;
- If cancellation by Collector Con occurs after the commencement of the Event, the Stall Fee will be retained by Collector Con.
Event Times
- In respect of the time that Events are to operate:
1. Bump in;
2. Stallholder Check-In;
3. Trading hours;
4. Bump out; and
5. any other timing or time restriction;
shall be determined by Collector Con, and Stallholders agree to comply with, and adhere to all such restrictions as relevant to each Event as communicated to them by Collector Con.
- Event times will be emailed to Stallholders. Reminders may be sent via email or SMS to Stallholders in the lead up to an Event.
- If a Stallholder has not checked-in during the Check-In time, the Stall allocated to that Stallholder may be re-allocated or removed, and the Stallholder forfeits all fees or moneys paid in contemplation of the Event, and no refund will be provided to the Stallholder.
- Stallholder vehicles (and any vehicles of persons assisting Stallholders) must be parked in the designated Stallholder parking areas before trading hours commence.
- Stallholders must be available at their Stall space during the trading hours. And for the safety of Visitors, Stallholders must end transactions with Visitors at the end of the Trading Hours so that Bump out can commence.
- Should a Stallholder continue interactions with Visitors during Bump out, they will be required to pay an additional Stall Fee. This Stall Fee will vary and be inclusive of staffing costs to escort Visitors during Bump-out and any fines issued by the Venue for exceeding allocated hiring times. Stallholders agree they are liable for any such fee so forwarded, and indemnify Collector Con in respect of any such fee.
The Stall Space
- The location and size of space for individual Stalls at the Event is determined by the Collector Con in its sole discretion.
- There is no requirement or obligation to give a particular Stallholder any particular space of any particular size or location at the Event.
- Tables set out at the Event are not to be moved or re-arranged from their set-up location without approval by Collector Con.
- Stallholder activities, including the distribution of promotional materials, must be contained and limited to their allocated Stall space.
- Stallholders agree and warrant, that the items and activities at their Stall will not and must not involve the sale, or any other dealings including free giveaways of the following:
1. counterfeit goods;
2. stolen goods;
3. weaponry;
4. items banned by any law or regulation;
5. explicit, indecent, violent, or defamatory material;
6. any items or goods which infringe any intellectual property, trade mark, patent or copyright or any rights of a third party;
7. AI-Generated content where majority of the creative output, composition or expression of the work has been produced by artificial intelligence systems;
8. food or beverage items, packaged or fresh;
9. items which are unsafe or likely to put any person’s safety, health, or life at risk or in danger in any way; and
Collector Con reserves the right to ask Stallholders to remove items from their Stall.
- Stallholders agree and acknowledge that Collector Con has the right to inspect and review any and every item and activity at their Stall, and take any action or step to stop, prevent or limit the exposure to any breach of these terms and conditions. This may include the immediate removal of any non-compliant items, removal of the Stall and Stallholder from the Event without refund, and/or cancellation of all future Event bookings by the Stallholder.
- Stallholders must take care of the Stall space (before, during and after the given Event), including the floors and walls of the Venue. If there is damage made to the Stall space, and the part of the Venue surrounding the Stall space referable to the Stall space, it is the responsibility of the Stallholder to pay for any repairs and rectify any damage made.
- If there are damages to the Stall space, the repair fee will be forwarded to the responsible Stallholder by invoice. Damage fees will vary according to the repair required. Stallholders agree they are liable for any such fee so forwarded, and indemnify Collector Con in respect of any such fee or damage.
- Stalls must at the end of the Event be left tidy by the Stallholder and in the condition in which they were originally presented to the Stallholder.
- If the Stall is left untidy, a cleaning fee will be forwarded to the responsible Stallholder by invoice. Cleaning fees will vary according to the clean required. Stallholders agree they are liable for any such fee so forwarded, and indemnify Collector Con in respect of any such fee.
Safety and Risk
- Stallholders are bound by, and will comply with, any policy and procedures communicated by Collector Con concerning the safe administration of the Event.
- Stalls must be set up in a manner that is safe for the relevant proposed activities intended to be carried out at the Stall, and Stallholders acknowledge that Collector Con does not accept responsibility for or any liability arising out of their failure to so set up the relevant Stall.
- Any displays, goods or products of the Stallholder must stay within the confines of the allocated space and must not impede on or block any aisle, other Stalls, walkways or exits.
- Any items that are placed under the table will be checked by the Stallholder throughout the Event to not be a hazard.
- Stallholders and their team are to alert Collector Con of any hazards or risks they perceive at or surrounding the Event.
- All activities, activations, and displays operated by Stallholders, whether they are those running activation stalls or otherwise, must be appropriate and safe in light of the context and surroundings of the Event and Venue.
Place of contract/jurisdiction
- These Terms and conditions are governed by the laws of New South Wales, Australia. Any disputes arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of New South Wales.
